We’re thrilled that an awesome developer like you wants to use our API, and we hope you can create nice applications. Our API is very flexible and with your skills and expertise we will have a powerful combination.

However, with power comes responsibility, which is why we wrote these terms to provide some fundamental rules for you to get started with our API. Please make sure you read them carefully, and remember that these Terms may be changed by SurveyLegend at any time as we progress. We will post all changes online, and may notify you by email if we regard the changes as significant.

Terms of Use of SurveyLegend API

Definitions

• API means the application programming interface, in addition to code, tools, documentation, and material associated with it, that SurveyLegend provides to you.
• API Content means any content or data made available to you through use of the API.
• App or Application means a software application, website, product or service that you create or offer.
• Access Credentials means the security API-key which can be generated by the owner of the Developer Account and is tied to their account, used to access the API.
• Developer Account means the account for which you are required to register in order to obtain the Access Credentials and access to the API. If you use an API key to for example to connect to other apps and services or to make an integration, then your SurveyLegend account is regarded as a Developer Account
• SurveyLegend means SurveyLegend AB, the Sweden-based company with organization number of 556819-1810, which owns the SurveyLegend platform.
• Terms means these SurveyLegend API Developer Terms.
• User means a SurveyLegend user or a user of your Application that uses the API.

1. Using the API

   1. Use is Subject to Terms. Whether you use the API and any API Content directly or through a third party App that uses the API, your usage is subject to compliance with these Terms. SurveyLegend grants you a non-exclusive, non-transferable license (without the right to sublicense) to:
      1. use the API only as necessary to develop, test, operate and support your App using certain API Content accessed via the API; and
      2. distribute or allow access to your integration of the API within your App to end users of your App. You may not sell, rent or redistribute access to the API or any API Content to any third party without SurveyLegend’s prior written approval.
   2. General Terms. If you use SurveyLegend’s services as a user, such use is subject to our Terms & Privacy Policy. Your App’s interactions with a SurveyLegend account (your own account or others that use your App) must also comply with with our Terms & Privacy.

2. Developer accounts

   1. Developer Account. Usage of the API is limited to owners of a SurveyLegend account (“Developer Account”). After creation of your Developer Account, you may create applications, for which you will receive access credentials (“Access Credentials”). Keep your Access Credentials secure and confidential, because you are solely responsible for any activities that happen under your Developer Account.
   2. Restrictions
      1. You may open multiple Developer Accounts to use the API, but SurveyLegend retains the rights to close your additional accounts if we come to conclusion that you have opened too many of them. For example if we find out that you have created multiple accounts to bypass API call limits or other restrictions; or if we find out that you misuse users’ data.
      2. If your Account is suspended or closed, you must not try to circumvent such suspension by registering for a new Account.
      3. You may not open an Account and use the API if you are a competitor of SurveyLegend, or directly or indirectly work for a competitor of SurveyLegend.
   3. Access Credentials. When you generate an Access Credential you may use it for any number of Apps that you develop. You can delete and revoke the Access Credential when it is not needed anymore. You may not sell, trade, or give your Access Credentials to any third party without our prior written consent. You will take reasonable measures to safeguard Access Credentials from unauthorized use or access.

3. Respecting users’ privacy

   We want to give our Users the best experience ever, and protect them against any misuse. They should be able to trust us and what we deliver to them. We do our best to protect our Users, Respondents and their data, therefore we expect anyone who uses the API to do the same.

   1. Respect Users’ Data and be compliant with the GDPR. Your App must use User data in a way that the User expects and is aware of. What your App does with users’ data, personal data, and collected data, must be clearly described for them, in an easy-to-understand description that you provide along with your App. You must obtain their permission before performing actions on their data, such as (but not limited to):
      • editing survey data
      • disclosing survey data to third parties
      • using survey data in a way not expressly instructed
      • editing survey questions or survey settings
      • distributing surveys
      • closing surveys
      • altering account settings
      • taking an account action on a User’s behalf

      You must read and understand the GDPR law if it applies to you, before using our API.

   2. Don’t Mislead Users. Your App must not be presented in a way which misleads Users. For example, your App must not:
      • be promoted in a way which is misleading to Users
      • use logos or trademarks in a way that it misleads or confuses them
      • impersonate a third party without their authorization
      • link to spam or malware sites
      • or use shortened URLs to mask destinations in a misleading way
   3. Don’t Encourage Bad Behavior. Your App must not encourage your Users to act in an inappropriate or illegal manner. Specifically, you must not:
      • encourage or cause Users to violate any law, terms of use or privacy policy, Anti-Spam Policy, etc..
      • facilitate or encourage the infringement of intellectual property
      • facilitate or encourage the publishing of private or confidential information
      • facilitate or encourage or display violence and or hate (for example against groups of people, against minorities, nationalities, ethnic groups, people with certain beliefs regarding religion, politics, sexual identity, etc..)
      • facilitate or encourage or display violence against animals
      • encourage collection of information we don’t allow users to collect (like social security numbers, credit card numbers and passwords)
      • encourage publishing of links to illegal or malicious content (including age restricted content to minors)

4. App requirements

   1. Privacy Content. Your App must include a privacy policy, in which you must describe how you handle any User data and personally identifiable information that may be collected from Users via the API. The language you use must be written in a non-technical and easy-to-understand way, describing why your App needs to access or collect user data, what kind(s) of data does it access and or collect, what happens to the data after it is accessed and or collected by your App, how you transfer the data and how and where it is stored in case the data is pulled out of our systems.
      You must abide by applicable local and international laws such as GDPR regarding the User’s privacy. You must abide by your own privacy notices and policies.
   2. Disconnection. You must make it easy and effortless for Users to disconnect or disassociate their account from your App, or delete their data, and you will not hide or obscure such functionality. Disconnecting or disassociating the account must result in removal of User’s data from your App’s database, when required by applicable law.

5. App restrictions

   1. Category Restrictions. The following types of Apps are not permitted to use the API:
      • Apps which do not use our API for conducting surveys or research and collecting feedback (e.g. you should not use SurveyLegend as an email service provider to send out non-survey content).
      • Apps which try to replicate core functionality of SurveyLegend’s tools (e.g. an App which white-labels SurveyLegend’s services).
      • Apps which take advantage of the exporting of API Content, to import SurveyLegend’s user accounts’ data into a SurveyLegend competitor’s product or service.
   2. Presentation Restrictions. Your App cannot replicate, frame, mimic or mirror the SurveyLegend website or its UI design, interaction design, illustration style, visual language, and generally its design.
   3. Functionality Restrictions. Your App may not:
      • crawl or datamine the API Content without consent from each relevant User or Users.
      • use the API to monitor and output the availability, performance or functionality of any of SurveyLegend products or services.
      • use the API to monitor and or analyze availability, performance or functionality of any of SurveyLegend products or services for other benchmarking or competitive purposes.
      • alter, remove, replace or mask any aspect of a SurveyLegend survey without SurveyLegend’s prior written consent.
      • be used in a way which enables Users circumvent any restrictions or limitations placed on their account, based on the type of SurveyLegend subscription plan they have (for example, the limitation on the number of surveys that can be created by a User, or ability of exporting data on a free subscription plan).

6. Technical restrictions

   1. API Call Limits. SurveyLegend may set limits on the number of API calls that your App is permitted to make. If we impose such limits, we may describe them on our API documentations. We may impose different limitations for Public Apps and Private Apps, or for different subscription levels. If you exceed the maximum allowed quantity of API calls you had purchased as specified on the features page, SurveyLegend may charge additional fees for the excess. Unused API calls will not roll over to the next period.
   2. Excessive Use. Abusive or excessive use of the API (as determined by SurveyLegend) may result in the temporary suspension or termination of your access to the API, if we assess or monitor that your use of the API generates a volume of API calls than what an average API use similar to your App would generate.
   3. Other Technical Limitations. Other technical restrictions imposed on Apps are:
      • If you provide an application programming interface that uses the API to return the data of Users, you may only return Users’ usernames or unique identification numbers. You must pull all other User data by using the API.
      • You may not use the API to aggregate, cache or store any place or geographic location information contained in API Content.

7. Legal restrictions

   Stay on the Right Side of the Law. Your App and your App’s use of the API must comply with all applicable (local and international) laws, regulations and rules. Your App must not be used to (and must not facilitate) spamming, phishing or linking to illegal content. It is your own responsibility to get to know, and follow the laws that apply to your App or business.

8. SurveyLegend’s brand assets

   1. Use of SurveyLegend Brand Assets. SurveyLegend’s name, logo, logotype, other trademarks (“Marks”), illustrations, and icons, are valuable brand assets of SurveyLegend. We would love and appreciate it if you want to mention SurveyLegend’s name in conjunction with your great Apps and creations. But please only do so in accordance with the terms in this section and our Brand and Trademark Guideliens. We may publish or update our brand use or trademark use guidelines on our website, including as part of our Brand and Trademark Guideliens, and use of SurveyLegend’s Marks will be subject to all such guidelines. All goodwill arising out of or related to the use of the SurveyLegend Marks by you shall inure to the benefit of SurveyLegend.
   2. No Endorsement. You may not use SurveyLegend’s Marks in a way that makes users believe or get a sense that your App or business has an affiliation, endorsement, or sponsorship by/with SurveyLegend. You can only do so if you have SurveyLegend’s written permission.
      • Your Apps must be clearly labeled and titles as your own, and not SurveyLegend’s
      • You may not label your product as a SurveyLegend product or use the SurveyLegend logo as part of your own logo.
      • You may not use SurveyLegend’s Marks as part of the name of your company or of any App or other product or service created by you.
      • However, you may use SurveyLegend’s name to show that your App is integrated with or is compatible with SurveyLegend, or that SurveyLegend provides the source of the API Content.
   3. Proprietary Notices. You may not remove, modify or make it difficult for users to understand any proprietary notices or marks on the API or in any API Content you obtain.

9. Fees

   Use of the API is currently limitted to paid subscriptions. For further information regarding limitations and prices check out our pricing or features pages.

10. Suspension and Termination

    1. Terminating or suspending abusive developer accounts At SurveyLegend will do our best to warn you if figure out that your App does not comply with these Terms, or if we find out about a compliance issue with the methods and ways in which you are accessing the API. This is to ensure that you can try to solve the problem. Notwithstanding the foregoing, if we believe that you have violated these terms or are accessing or using the API in any way that SurveyLegend regards as abusive, illegal, or that causes liability or detriment to SurveyLegend, SurveyLegend may immediately, and without any notice, suspend or terminate your access to the API, to your Developer Account, and to any API Content. SurveyLegend retains the rights to terminate these Terms for any reason, with or without notice to the email address associated with your Developer Account. You may terminate these Terms for any reason by stopping to access the API, stopping to use any API Content, and or by canceling or deleting your Developer Account.
    2. Cooperation in solving compliance issues. You agree to help SurveyLegend, at its request, to verify compliance with these Terms by providing us with information about your App, including providing us with access to it and/or other materials related to your use of the API.
    3. Consequences of termination. Upon termination of these Terms, you will cease accessing the API and will delete all API Content. Sections (Restrictions), 8 (SurveyLegend Brand Assets), (Consequences of Termination), and (IP Ownership) to (Terms for Non-U.S. Developers) will survive the termination of these Terms.

11. More legal terms

    1. Limited License to Your Content. You grant SurveyLegend a worldwide, royalty free license to use, reproduce, distribute, modify, adapt, create derivative works, make publicly available, and otherwise use your copyrights, trademarks, patents, publicity, moral, database, and/or other intellectual property rights in and to your App, but only for the limited purposes of promoting and marketing SurveyLegend, our API, and any API content in any media. This license also extends to any trusted third parties we work with.
    2. Integrations list. SurveyLegend has the right to include and promote your application in places where we display a list of integrations, developed to work with our platform. Notwithstanding your App being displayed in such lists, you agree that SurveyLegend may for any reason demote or remove it from the lists.
    3. Modifications and Support. SurveyLegend may provide you with support for the API in our sole discretion. SurveyLegend retains the rights to modify the API at any time without notice or liability to you. If you continue to access the API after such modifications, such act will be considered your acceptance of the modifications.
    4. IP Ownership. You acknowledge that SurveyLegend and its Users retain all worldwide rights, title and interest (including intellectual property rights) in and to the API Content. You acknowledge that SurveyLegend or its licensors retain all rights, title and interest (including intellectual property rights) in and to the API and the SurveyLegend Marks (and any derivative works or enhancements). You shall not do anything inconsistent with such ownership. Rights not expressly granted by these Terms are reserved by SurveyLegend.
       Subject to the foregoing, you retain all worldwide rights, title and interest (including intellectual property rights) in and to your App. If you provide SurveyLegend with any feedback or comments concerning the API or API Content, you agree that SurveyLegend may use, reproduce, license, distribute and use in any other way, such feedback or comments.
    5. Similar or Competitive Products or Services. You agree that SurveyLegend may independently develop, or have developed for it by other parties, products or services that are similar to or otherwise compete with your App or integrations with SurveyLegend’s products and services, and nothing in these Terms will be construed against that.

12. Disclaimers

    1. Disclaimer of Warranties. ACCESS TO THE API AND THE API CONTENT IS PROVIDED “AS IS” WITH NO WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND AND SurveyLegend EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, SECURITY, TITLE, AND NON-INFRINGEMENT.
       SOME API FEATURES MAY BE EXPERIMENTAL AND UNTESTED. SurveyLegend DOES NOT REPRESENT OR WARRANT THAT THE API IS FREE OF INACCURACIES, ERRORS, BUGS, OR INTERRUPTIONS, OR ARE RELIABLE, ACCURATE, COMPLETE, OR OTHERWISE VALID. YOUR USE OF THE API AND API CONTENT IS AT YOUR RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM USE OF THE API, INCLUDING FOR ANY DAMAGE TO YOUR COMPUTER SYSTEMS OR LOSS OF DATA. WHILE SurveyLegend STRIVES TO MAKE THE API AVAILABLE WITHOUT INTERRUPTION, SurveyLegend DOES NOT GUARANTEE THAT THE API WILL ALWAYS BE AVAILABLE AND DOES NOT PROVIDE ANY GUARANTEES AS TO SERVICE LEVELS.
    2. Indemnity. You agree to indemnify and hold harmless SurveyLegend, its affiliates, and their directors, officers, employees and agents, from and against any third party claim, losses, damages, suits, judgments, liability, and litigation costs (including reasonable attorneys’ fees) arising from or related to your use of the API or the API Content or your violation of these Terms.
    3. Limitation of Liability. YOU AGREE THAT SurveyLegend SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SurveyLegend HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF THE API OR THIRD PARTY PRODUCTS THAT ACCESS API CONTENT. IN ANY EVENT, SurveyLegend’S AGGREGATE, CUMULATIVE LIABILITY TO YOU ARISING IN CONNECTION WITH THESE TERMS WILL NOT EXCEED US$75.

13. General

    If any provision of these Terms is determined to be invalid or unenforceable by a court, such provision shall be deemed severable and the remainder of these Terms shall remain in full force and effect. The failure by SurveyLegend to enforce any right or provision of these Terms shall not constitute a waiver of that provision or of any other provision of these Terms. You agree that you, and not SurveyLegend, is responsible for determining which laws may apply to your use of the API and the API Content and assessing your obligations under such laws. These Terms comprise the entire agreement between you and SurveyLegend with respect to its subject matter and supersede any prior or contemporaneous understandings, representations and other communications (written or oral) between you and SurveyLegend.
